For legal reasons you must be of legal age (18+) in order to purchase from me or entering into giveaways

With the exception of physical stickers and stationary items, artworks/items are for digital products only and you will not receive any physical items

I do not take on commissions of copyrighted material that the client does not have the rights for or license to have produced, with the exception of material where the copyright holder has made it openly available

If you purchase anything for the purpose of gifting the rights goes to the giftee and you will not have any rights to it. You are responsible for them knowing the terms laid out here

I will keep all copyrights of all artworks - meaning you cannot resell the files/images or distribute them unless otherwise agreed on (see more under MERCHANDIZING)

I do not take on any responsibility to insure that you have the proper copyrights or licenses for the characters or designs you commission me for, or that you submit to giveaways or freebie art

I reserve the right to turn down any commission for any reason without disclosing why

I will have the right to share images of commissions for the purpose of promoting my business and showcasing my work and may also work on them while streaming - If you have a release date I need to wait for please disclose this when commissioning me, or when submitting for giveaway/freebie art

I do not take responsibility for art or asset(s) complying with the terms of the website you want to use them on. If commission, I will work with you to the best of my ability to make it comply (if for example Twitch does not accept an emote) when possible

I will keep you updated through the commission process and I will share sketch as well as final version for approval (see more under PROCESS)

I will keep you updated if delays occur

You are not permitted to use the artwork(s) for profiting from, advertising for or using in relation to AI generated images, blockchain-related technology, cryptocurrency, NFTs, and related future inventions, or to provide it to anyone you know or should know would use it for the before mentioned activities

You are responsible for having the proper copyrights and/or licenses for the character or design you commission me for, or that you submit for giveaways or freebie art, and you take on any and all responsibilities related to this now and in the future

You are responsible for art or asset(s) complying with the terms of the website you want to use them on

Please provide as much descriptions/references as needed for the commission you're looking for when submitting the commission form and throughout the process

Please let me know of any important things related to the commission - this can be if I need to wait for a release date before sharing anything or if there's a deadline (I cannot guarantee specific deadlines unless agreed on before commission accept)

If you would like any changes or tweaks throughout the process, please let me know - I want to do all I can to make the artwork exactly what you want

You have exclusive license to using commissioned/giveaway/freebie item(s) privately, as well as indirect profit commercial license to use on 1 account/server per social media platform such as Discord, Twitch, TikTok, Youtube, etc (see more under USAGE RIGHTS TYPES)

For YCH commissions/giveaway/freebies, you only have exclusive license over your custom version of the YCH and cannot prohibit other people from using other versions of these

You are permitted to upload emote(s) to your Discord server, Twitch channel and TikTok so your community can have access to them through these

You are not permitted to share the file(s) or otherwise distribute the item(s) or use the items in a commercial way (other than what is stated above), for profit or as merchandise unless otherwise agreed on (see more under MERCHANDIZING)

You are not permitted to alter or change the items in any way, including but not limited to resizing, recoloring or animating, or to replicate them unless otherwise agreed on

If you break the terms of service after commission/artwork is completed your rights and licenses will be revoked and you must remove the items everywhere they are shown and used, or in the case of merchandise all items that are being sold/distributed

You must give me credit where appropriate - for example attribute the emote to me on Twitch (@zaraglowious) or list me on your website

Once I receive your inquiry I will reach out to you to discuss your wishes further and to be sure of what you are looking for

Payment will happen automatically through Ko-Fi or via PayPal invoices (see more under PAYMENT)

I will keep you updated on the process, and I will send you sketch as well as final version for approval - in some cases flat color approval or other may also be needed

If you would like any changes, 1 full redraw of the sketch as well as smaller changes are included - additional sketches or larger changes may have a fee (5-10€+)

After sketch approval only smaller changes (such as color correcting) are possible

The production time is approximately 1 to 8 weeks from sketch approval, depending on the commission type, size and complexity, as well as other projects I'm working on

When the commission is finished I will send the file(s) to you via your disclosed email

The specifics of the giveaway will be shared with the giveaway post

After giveaway has ended I will then draw the winners according to the specific giveaway and will announce the winners on Twitter/Instagram with instructions to contact me - please do so within 48hrs

Winners must share references and email for me to sent the finished items, as well as other information needed for the specific giveaway

I will sent a sketch as well as finish piece for approval - smaller changes are included, bigger changes may have a fee

After final approval I will sent the items to disclosed email

Giveaways will be worked on in between paid commissions and may therefore take longer to complete than the normal turnaround time

Sharing your character design does not guaranty I will use it for the art challenge or practice, and therefore does not guaranty you will receive a freebie

If I use your character design I will use it to create the piece without you having any input on how it looks

I will share it on social media and I will need your email to sent it to you

Smaller changes like color correcting or if important elements are missing are included, if you would like bigger changes to the design there may be fees in order to do this

Merchandize license is needed to be able to create products - such as t-shirts, mugs, keychains, stationary, caps and similar - using the artwork for the purpose of selling, distributing or giving away

The price to purchase a merchandize licens is 50%-200% of item cost (see COMMISSIONS) depending on the artwork

It is not possible to receive a merchandize licens for premade items (with the exception of adoptable characters)

You are not permitted to use artworks for profiting from or advertising for blockchain-related technology, cryptocurrency, NFTs, and related future inventions

With a merchandize license you are permitted to share the files with vendors and distributors for the purpose of creating, selling and distributing the merchandize products, as well as for creating merchandize material (such as pamphlets or tags for the products)

I will keep the copyright for the artwork itself and you cannot distribute or sell the image(s)/file(s) themselves, other than for the purpose of creating merchandise products and material as stated above

When selling merchandise products you cannot claim the art as your own and must give me credit as the artist where appropriate

You will receive a merchandize license with your files

Items will be send as standard non-trackable letter postage, if you wish for tracking you must select this when purchasing

Giveaways are including non-tracking letter postage, if you wish for trackable postage you may pay the difference for this. You must let me know when providing address and I will sent you an invoice through PayPal. The difference must be paid before I ship the items to you

The items are for personal use only

If there are any issues with purchased items please contact me through Ko-Fi/Etsy or directly to [email protected] as soon as possible so we can resolve it best together (see mote under DELAYS, CANCELLATIONS & RETURNS)

Payment will happen through PayPal invoice and Ko-Fi/Vgen payment system

PayPal invoice will appear as ZMJ Art

Possible credit note/refunds will be sent via PayPal or payment system

Payment through Ko-Fi or VGen will happen upon purchase

Payment through PayPal invoice must be received within 48 hours after the invoice is sent, if I do not receive the payment within this time it will be taken as a cancellation (see more under DELAYS, CANCELLATIONS & REFUNDS)

For returning clients, a payment plan can be arranged depending on the order size

If I do not receive the payment plan installment within 24 hours of agreed upon payment schedule it will be taken as a cancellation (see more under DELAYS, CANCELLATIONS & REFUNDS)

Possible additional charges through the creating process will be sent together in a final PayPal invoice

All outstanding invoices must be paid in full before you will receive the finished item(s)

If I do not receive the payment(s) within 24 hours of the final approval it will be taken as a cancellation (see more under DELAYS, CANCELLATIONS & REFUNDS)

If you for any reason are unable to pay an invoice please reach out to me upfront or before the payment is due, so we can discuss the options. Otherwise I cannot guarantee that I can work with you in the future

Payment will happen through Ko-Fi or Etsy payment system

Payment may appear as ZMJ Art

Possible refunds will be sent via PayPal or payment system

Payment will happen upon purchase

Because of the nature of digital products there will be no refund offered after the finished files are emailed to you or if you have purchased digital items from my shop

I reserve the right to delay fulfilling a commission without disclosing why

If delays occur I will keep you updated

There are no refunds or discounts if delays occur

If you want to cancel a commission please let me know as soon as possible

If you cancel a commission there is 90% refund of amount paid if I have not started the work (10% administrative fee)

If you cancel a commission there is 50% refund of amount paid if I have started the sketch

If you cancel a commission there is 0% refund of amount paid if the sketch has been approved

If I do not hear from you within 7 days after reaching out to you for skecth/final approval or other it will be taken as a cancelation from your side unless otherwise agreed on

If you cancel a commission you will need to fill out a new commission inquiry and possibly make new payment(s) if you still wish to commission me

I reserve the right to cancel a commission without disclosing why, but I will of course contact you about it as soon as possible

If I have to cancel the commission you will receive 100% refund of amount paid no matter where in the process I am

Refunds will be issued through PayPal, Ko-Fi or Etsy

Refunds will be issued within 1-3 business days of cancellation and you will receive it within this time + the processing time

You are not permitted to issue a so called "chargeback" through PayPal or other, as described above I will refund you

If you breach the terms of service laid out the commission order will be annulled without you being entitled to a refund

If you wish to cancel a physical order you must contact me within 24 hours of your purchase

If you cancel a physical order within 24 hours of purchase there is a full refund of amount paid

If you wish to cancel a physical order efter 24 hours of your purchase the item(s) may already have been shipped to you and if so you will need to return them instead

If you wish to return a physical order you must contact me within 14 days of receiving the item(s)

You must send the item(s) back to me at your own cost in order to receive the refund

To receive a refund, item(s) must be send back in the same condition as received and sealed packaging may not have been opened or the item(s) otherwise used

If there are issues with items or shipping you may receive a refund without shipping the items back to me - depending on the specific situation

You can contact me either through Ko-Fi/Etsy or email me at [email protected] to give me notice of cancellation or return, or any issues with the order

Refunds will be issued through PayPal

Refunds will be issued within 1-3 business days of cancellation or my receipt of returned items, and you will receive it within this time + the processing time of PayPal, Etsy and/or your bank

You are not permitted to issue a so called "chargeback" through PayPal or other, as described above I will refund you

To fulfill a commission I need your email address and name and/or business name for communication and possibly for the purpose of payment

Further information such as address or social media- and business information may be needed for completing your order

To fulfill a shop order I may be provided your PayPal email address, name and/or other contact information upon purchasing

Personal information such as email, name and address may be shared with me when purchasing, commissioning or joining membership by Ko-Fi, Etsy or PayPal

In order to share giveaway, raffle or freebie item(s) with you I will need your email for sending it to you when finished

For physical items you will have to provide your name and address for shipping item(s) to you

Pictures or art references may be needed for commissions, giveaway or freebies. These will be deleted from my possession and from possible cloud storage once the work is completed

All information provided will be stored with me for the purpose of fulfilling your commission or shop order and some may be used for my financial records

Information given will not be used, traded or shared with other people or entities without your permission with the exception of third-parties that are needed for the completion of your commission or order

By commissioning, purchasing from me, or submitting for a giveaway or freebie, you agree to information possibly being stored or shared with: PayPal; Ko-Fi; Vgen; Etsy; Google; Apple; X (formerly Twitter); Instagram; TikTok, Youtube, Trello as well as financial government agencies

You agree to your social media handle(s) possibly being shared through promoting my business and sharing my work

You need to provide your email address when signing up for the newsletter, the newsletter is issued through BeeHiiv and the email address is therefore shared with them. You can unsubscribe anytime through their website or the newsletter emails send to you

You need to provide your email address when using the email contact form on this site, and it will therefore be shared with Carrd for the purpose of getting your email to me

You have the right to revoke the consent of me having the information you provided, please let me know if that is ever the case and I will remove it from my possession to the extent I am able to
